Explained: New penalties for each offense under the Motor Vehicles Act 2019


Unauthorized use of vehicles without authorization - fine Rs.5000


Driving without a license – Rs 5000 fine


Driving despite disqualification – Rs 10,000 fine


Acting as a conductor after disqualification - fine up to Rs.10,000


Punishment related to construction, maintenance, sale and conversion of motor vehicles and their parts - imprisonment up to 1 year and/or fine up to Rs 1,00,000 per vehicle.

Defective Vehicles – Imprisonment up to 1 year and/or fine up to Rs 1,00,000 for defective automobiles.

Alteration of retrofitting contrary to rules - Imprisonment up to six months and/or fine of Rs 5,000 for each alteration

Oversized vehicles – Rs.5,000

Speeding – Rs 1,000 to Rs 2,000 for LMV; Rs 2,000 to Rs 4,000 for medium cars or trucks; Second subsequent offense - revocation of driver's license

Punishment for dangerous driving – first offense – imprisonment for six months to one year and/or a fine of Rs 1,000 to Rs 5,000; Subsequent offense (within three years of the first offence) – Imprisonment up to two years and/or Rs 10,000

Drunk driving - first offense - fine up to Rs 10,000 and/or imprisonment up to six months; second offense - fine of Rs.3000 and/or imprisonment for a term which may extend to two years

Penalty for driving while mentally or physically unfit to drive - first offense - fine up to Rs 1,000; second offense – fine up to Rs.2000

Punishment for offenses relating to accident (Sections 132 (i), 133 and 134) – First offense – fine up to Rs 5,000 and/or imprisonment for 6 months; second offense – fine up to Rs 10,000 and/or imprisonment for 1 year
